Negative option billing means you are charged unless you take action to stop it. Free trials that flip to $14.99/month, pre-checked “auto-renew” boxes, and “cancel by phone only” clubs are common forms. This guide is about spotting consent and billing traps. It is not the keep/pause/cut audit in Cut subscriptions carefully.
Red flags at signup
| Signal | What it looks like | Safer check |
|---|---|---|
| Pre-checked renew | Box already ticked for annual renew | Untick; screenshot before pay |
| Trial flip buried | “$0 today” with paid price in footnote | Find post-trial price + date in dollars |
| Dual consent | Marketing emails + billing share one checkbox | Separate toggles; decline marketing if needed |
| Hard cancel | Sign up online, cancel “by phone 9–5 only” | Prefer sellers with online cancel in ≤3 clicks |
| Bundle silence | “VIP” added at $9.99/mo on checkout page 2 | Remove add-ons before submitting |
U.S. rules (including ROSCA-style clear disclosure expectations for many online sellers) push for clear offer terms, informed consent, and simple cancel. Treat fuzzy screens as a walk-away signal.
How to verify billing consent (10 minutes)
- Open the confirmation email and find amount, cadence, renew date, cancel URL.
- In the account portal, find subscription / membership / auto-renew and confirm status On/Off.
- Check Apple App Store / Google Play subscriptions separately from the website account.
- On the card or bank feed, label the merchant descriptor (e.g.
ACME*TRIAL) so renewals are visible (Budgeting basics). - Calendar a reminder 3 days before the trial end or annual renew.
Worked example: “free” trial → $59.88/year
Alex starts a 14-day free trial. Checkout footnote: $4.99/month billed annually at $59.88 unless canceled 24 hours before day 14.
| Day | Event | Alex’s action |
|---|---|---|
| 0 | Trial starts; auto-renew pre-checked | Unticks renew if allowed; screenshots terms |
| 11 | Calendar alert | Cancels in portal; saves confirmation PDF |
| 14 | No charge | Success |
| If skipped after agreeing to renew | Day 14 charge $59.88 | Cancel future renewal in the portal and ask the merchant for a refund; keep the confirmation |
| If consent was missing, terms were deceptive, or billing continued after a timely cancel | Unauthorized or invalid charge | Document the facts, then use the issuer dispute path |
Alex also watches for look-alike Netflix-style descriptors that are scams, not the real subscription (Fake Netflix billing scams).
Negative option vs “I meant to keep it”
| Situation | Use this guide | Use another guide |
|---|---|---|
| Unclear consent / trial trap | Yes | n/a |
| Too many services you do use sometimes | Spot first, then trim | Cut subscriptions |
| Gym contract notice and exit fees | Consent history helps | Cancel gym without fees |
| Spend rising because renewals stack | Flag renewals | Lifestyle creep |
